With Legislative Decree No. 24 of 10 March 2023 (Official Gazette 15.03.2023), the EU Directive 2019/1937 concerning the protection of persons who report breaches of national or Union law that harm the public interest or the integrity of a public administration or private entity, and of which they have become aware in a public- or private-sector employment context (so-called whistle-blowing regulation), has been transposed.
The purpose of the new regulation is to establish common minimum standards to encourage the reporting of wrongdoing by instituting secure internal, external and public disclosure channels that ensure, among other things: the confidentiality of the reporter and the processing of their personal data; the implementation of suitable procedures for prompt and efficient management of reports; the application of rules aimed at preventing or nullifying the effects of retaliatory behaviour towards the reporter; the imposition of pecuniary and administrative sanctions for violations of the provisions under the new regulation.

Maximum confidentiality is guaranteed with respect to the persons and facts reported, and, in any case, with respect to the identity of the whistle-blower and the information transmitted in order to ensure that the person making the report is not subject to any form of retaliation.
